RELEASE AND WAIVER OF LIABILITY

FOR VOLUNTEERS OF SHEPHERD HELP AND RESCUE EFFORT, INC.

FOR GOOD AND VALUABLE CONSIDERATION, including allowing THE UNDERSIGNED to observe, assist, and/or participate in caring for the dogs, including, but not limited to, feeding, walking, visiting, jogging, biking, fostering, rescue operations, escorting dogs to events, transporting, and/or assisting with adoptions/adopters and/or adoption events (collectively “Volunteer Work”), THE UNDERSIGNED, agrees as follows:

THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY  DAMAGE  arising  out of the observation, assistance, and/or participation  of  any kind  in Volunteer Work by THE UNDERSIGNED, including any bodily injury, death or property damage caused by the acts or omissions of owners, employees, agents, representatives and/or lessees of Shepherd Help and Rescue Effort, Inc. (collectively, "Releasees") or due to the actions or behaviors of the dogs, or while observing, assisting, and/or participating in any event on behalf of Shepherd Help and Rescue Effort, Inc.  THE UNDERSIGNED  recognizes and understands that the Releasees will not cover, nor will Releasees’ insurer cover any accidents,  injuries,  dog  bites,  or  any  other  incidents  that  occur  while participating in Volunteer Work.  THE UNDERSIGNED recognizes and understands that there are inherent risks and dangers associated with observing, assisting, and/or participating in Volunteer Work that could cause serious bodily injury, disability or death, including risks or dangers caused or created by acts or omissions of the Releasees and others. All of the risks and dangers associated with observing, assisting, and/or participating are assumed by THE UNDERSIGNED notwithstanding. In  return for THE UNDERSIGNED being allowed to observe and/or participate in Volunteer Work, THE UNDERSIGNED hereby releases the Releasees from any and all claims, present and future, and agrees not to sue any Releasee for any present or future claims, that could be made by THE UNDERSIGNED, my family, estate, heirs, assigns, or any other person or entity on my behalf, for property damage, personal injury, or wrongful death arising out of THE UNDERSIGNED observing and/or participating in Volunteer Work including, without limitation, claims caused by the negligence of any of the Releasees, wherever, or however the damage, injury, or death may occur. THE UNDERSIGNED further agrees to indemnify, defend and hold harmless the Releasees for any loss, liability, damages, costs or claims made by, or on behalf of, THE UNDERSIGNED for any claim of property damage, personal injury, or wrongful death arising as a result of THE UNDERSIGNED observing and/or participating in Volunteer Work, including any costs of defending or settling a claim made against Releasees (including, without limitation, attorneys' fees). THE UNDERSIGNED is voluntarily observing and/or participating in Volunteer Work with knowledge of the danger involved, and THE UNDERSIGNED agrees to accept and assume all risks of observing and participating in Volunteer Work and all related activities. Neither Shepherd Help and Rescue Effort, Inc., nor any Releasee, has undertaken to determine whether THE UNDERSIGNED has any medical condition that can cause THE UNDERSIGNED to be unfit to observe and/or participate, and THE UNDERSIGNED acknowledges and agrees that neither Shepherd Help and Rescue Effort, Inc., nor any Releasee has any duty to do so. THE UNDERSIGNED agrees that this Release and Waiver of Liability and Indemnity Agreement extends to any and all acts of negligence by Releasees and is intended to be as broad and inclusive as is permitted by the laws of the State of Florida. THE UNDERSIGNED agrees that any legal proceedings arising out of or relating to this Waiver and Release of Liability and Indemnity Agreement and/or his/her observing and/or participating in Volunteer Work will take place in Broward County, Florida.

THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER OF LIABILITY AND DOES SO VOLUNTARILY AND WITH THE UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP. THE UNDERSIGNED FURTHER ACKNOWLEDGES THAT FAILURE TO WITNESS OR NOTARIZE THIS AGREEMENT SHALL NOT AFFECT ITS VALIDITY.  BY SUBMITTING THE VOLUNTEER APPLICATION, THE UNDERSIGNED CONSENTS/AGREES TO THE ABOVE.
